When it comes to repairing your credit, there might come a time that you wish to contact your state attorney for assistance. A state attorney is an elected official who serves two or more years in the position, and serves as a legal advisor within their elected state. Every state has such an attorney, and they are responsible for protecting consumers, like yourself, from fraud.

Each state has laws in place to protect the rights of consumers. It is the job of the state attorney to assure that these laws are followed. If these laws are not followed, it is the state attorney’s job to prosecute and/or fix the troubling or illegal matters.

For the most part, citizens generally come into contact with their state attorney through the Division of Consumer Protection. The job of this division is to protect your rights and to assure that you have not been wronged by a business or credit company. They do this by prosecuting businesses and individuals who carry out their collections and practices in illegal, fraudulent, or deceptive manners. The Division of Consumer Protection does exactly what their name implies: Protect.

As a consumer, it is your right to contact your state attorney if you are feeling harassed by a creditor or if you feel that they have taken some form of illegal action against you in the process of attempting to collect a debt.

You should first look into your states individual laws for collection or debt processing. Once you have familiarized yourselves with the intricacies of you state laws, you will want to begin and document any misgivings or deceits that you experience while dealing with creditors. You will want to do this by collecting information and keeping a log of any contact you have with creditors. Take down specific names and note all dates and times that contact is made. Write down the process which you have taken and followed. The more you can document, the better off you will be when it comes to actually pursing a negative creditor. Some state laws even allow consumers to legally record any conversations they have with creditors.

Once you have collected such information you can then contact your state attorney and present them with the information you have collected.

In most cases, when a complaint has been turned over to the state attorney they will contact the business or individual in question, whom the complaint has been made about and will present the information and facts that you have presented. The best part about this is that businesses are very aware that the state attorney has the ability to shut a business down or fine them for any wrong doing. They take state attorney complaints seriously and generally will accept a fine or settle with the complaining consumer in order to avoid any type of prosecution.

Creditors will not even attempt to provide fraudulent or incorrect information to the state attorney. So if you feel as if you have been wronged by a creditor and you have exhausted yourself with dealing with the creditor then contacting your state attorney may be your best bet.

This is interesting…I was not aware that one could contact the state attorney for assistance if being harassed by creditors or treated unfairly. I live in Australia and I will look into whether the same applies here. We do have Consumer Protection here and that may be the place to start. Thanks for an informative post.
